Purchase and subscription terms

Who sells and who collects payment, what the plans include, and how a subscription is activated, renewed and cancelled.

1. Who sells and who collects payment

These terms are accepted when you subscribe to a paid plan and govern that relationship alone: they do not bind anyone who uses PINTRU without taking out a subscription. Separate, and accepted at different moments, are the terms of use, which apply to anyone creating content even free of charge, and the integration terms, which apply to anyone installing the integration code on a website.

The PINTRU service is provided by Thomas Casadei, VAT number 04151640408, registered at Galleria OIR 16, 47521 Cesena (FC), Italy, tax code CSDTMS78T14C573H, email: info@pintru.com.

2. The plans and what they include

PINTRU is offered in a free plan and in one or more paid plans, differing in the features included and the limits applied, among them the number of active items of content, the pin categories available, the ability to make one's content public, attachments, collaborative features and verification features.

What forms the subject of the contract is the offer in force — the available plans, their prices and what each contains — as published on the website and shown in your personal area at the time of purchase, and not a list reproduced in this document.

New plans may be introduced, and existing ones changed or withdrawn; there may also be plans that cannot be bought publicly, being reserved or assigned at our discretion. Withdrawing a plan does not affect subscriptions already active at the time of the change, to which the section Changes to plans and prices applies.

Some features may be offered on trial, in limited or progressive form, and their availability may depend on the country, the language or the context of use.

Limits on the number of items of content refer to active content: deleting some of it frees up capacity. If you move to a lower plan, content exceeding the new plan's limits is not deleted and remains visible to its author, who cannot however create new content until back within the limit.

3. A precondition of purchase: email address verification

Using PINTRU does not require confirming your email address. Subscribing to a paid plan does: without confirmation the purchase flow stops and you are asked to complete the verification.

The address is the contact point for communications about the subscription and makes it possible to trace a payment back to an account. The confirmation message can be requested at any time from your personal area.

4. How to purchase, and activation

  1. The customer selects the plan from their personal area.
  2. The customer is directed to the provider's payment pages, where they enter the necessary details and complete the order.
  3. Once payment succeeds, the provider notifies PINTRU's system of the outcome and the plan is activated on the account.

Activation is normally immediate. Should the plan not be active within a reasonable time after payment, the customer is invited to write to the contacts quoting the order reference received from the provider.

The service contract is deemed concluded at the moment the plan is active on the account.

5. Automatic renewal

The subscription runs monthly and renews automatically at the end of each period until cancelled. At each renewal the charge is made by the payment provider using the method chosen at the time of purchase and at the economic conditions then in force.

The end date of the current period can be consulted in your personal area.

6. Cancellation and change of plan

Cancellation may be exercised at any time, with no penalty and no obligation to give reasons, from your personal area. Cancellation does not take immediate effect on the service: the subscription stays active until the end of the period already paid for and, at expiry, the account moves automatically to the free plan with no further charges. Until that date the customer keeps access to every feature included in the plan.

Cancellation takes effect from the moment you exercise it, regardless of the outcome of the technical operations that follow. At the same time we stop the renewal with the provider that handles collection; if that operation fails, we take it upon ourselves and, should a later charge result from it, we refund it in full without your having to ask.

Once the subscription has expired it is always possible to take out a plan again. Withdrawing a cancellation already sent depends on the procedures of the provider handling collection and is not guaranteed at present.

Should a further charge occur after cancellation, the customer is invited to contact the contacts without delay, enclosing the order reference.

7. Deleting the account

If the account is deleted while a subscription is active, the subscription is cancelled with the payment provider before the data is deleted: the cancellation request goes first, because collection takes place at the provider. Should that request fail, the event is recorded and handled manually; the customer is invited to check the status of the subscription with the provider as well.

Deleting the account is final and does not in itself give rise to a refund of the period already paid for.

Of the billing data, what is strictly necessary for accounting obligations remains — plan, status, subscription references and dates, without email address or personal particulars — for the period stated in the privacy notice. The remainder is deleted or anonymised as described there.

9. Withdrawal, refunds and conformity of the service

Right of withdrawal. If you are a consumer you have the right to withdraw from the contract within fourteen days of its conclusion, without giving any reason and without penalty.

To exercise it, an explicit statement sent to info@pintru.com is enough, or the model form reproduced below. It is enough to send the communication before the deadline expires.

What the service consists of. The subscription gives you access to the plan's features and, as regards fact-checking, a set number of verifications per period, stated on the plans page at the time of purchase. Each verification is a service in itself, carried out at your request and delivered the moment you ask for it: this is the unit by which how much of the service has been supplied to you is measured.

Immediate performance and waiver. The service is activated immediately after purchase. When you place the order you are asked to declare expressly that you want performance to begin at once and to acknowledge that, in that case, you lose the right of withdrawal. This is the option provided for by art. 59(1)(o) of the Italian Consumer Code for digital content supplied on an intangible medium. Without that request and that acknowledgement, the right of withdrawal remains fully exercisable within the fourteen days.

If the waiver does not apply. Should that declaration not have been made, or should the relationship be classified as a digital service rather than digital content, the right of withdrawal remains exercisable within fourteen days. In that case, since you asked for performance to begin at once, you must pay an amount proportionate to what has been supplied to you up to the moment of withdrawal, under art. 57(3) of the Italian Consumer Code. The proportion is calculated on the verifications you have used against those included in the period, because verifications are how the service is defined: if you have used them all, the service has been supplied in full. The rest is returned to you.

Refund. The refund is made within fourteen days of receiving the withdrawal notice, using the same means of payment used for the purchase, unless you expressly agree otherwise. The costs of the transaction are not charged to you: collection fees and payment charges stay with us and are not deducted from what is due to you. The only sum that may be retained is the one proportionate to the service already supplied, in the case described in the previous paragraph.

Lack of conformity. Regardless of withdrawal, if the service does not conform to what is owed you are entitled to have conformity restored and, where that is not possible or does not happen within a reasonable time, to a price reduction or to termination of the contract, under articles 135-octies et seq. of the Italian Consumer Code. In a continuous supply the burden of proving conformity lies with us for the whole duration of the contract: it is not for you to demonstrate the malfunction.

Order confirmation. You receive confirmation of the contract by email within a reasonable time of its conclusion, including these terms and the declarations made when placing the order.

Nothing in this document limits the rights granted to consumers by law.

10. Changes to plans and prices

PINTRU may change the plans, the features included, the limits and the prices. For subscriptions in progress, unfavourable changes apply from the next renewal onwards and are communicated with reasonable advance notice to the email address associated with the account; a customer who does not wish to accept them may cancel before they take effect. Notice is at least 30 days.

11. Failed payment

If a renewal fails, the payment provider may make further attempts under its own rules. Failing payment, the subscription may be suspended or closed and the account moves to the free plan, with the limits that come with it. Content is not deleted for this reason.

12. Final provisions

Partial invalidity. The invalidity or ineffectiveness of any single clause does not affect the remaining ones, which retain full effect.

Forbearance. Failure or delay in exercising a right does not constitute a waiver of it.

Assignment. PINTRU may assign the contract as part of a sale or contribution of the business or of the branch to which the service belongs, provided that this entails no reduction in the guarantees granted, with at least 30 days' notice. Anyone who does not wish to continue with the assignee may end the relationship and, if they hold a paid plan, obtain a refund of the portion relating to the unused period.

13. Complaints and contacts

For support with the service and for complaints: info@pintru.com. For matters concerning payment, the order and the tax document, it may also be necessary to contact the provider that made the sale, using the references given in the order confirmation.

Alternative dispute resolution bodies entered in the list kept by the Italian Ministry of Enterprises and Made in Italy are available. The European ODR platform has been shut down and can no longer be used.
